These Terms of Use (“Terms”) govern your access to and use of certificate.ge and the SheniEkimi Accreditation service (the “Service”), operated by the Public Health Institute of Georgia (“PHIG”). By accessing or using the Service you agree to these Terms. If you act for an organisation, you confirm you are authorised to bind it.

1. Nature of accreditation

SheniEkimi Accreditation is a voluntary quality and safety scheme. It is not a regulatory authorisation, licence or permit, and it does not replace any licence, registration or approval required by law. A facility remains fully responsible for obtaining and maintaining all legally required authorisations.

Accreditation reflects an assessment against the standard at a point in time. It is not a guarantee of safety, quality, clinical outcome or continued compliance, and it does not approve, certify or endorse any drug, device, product, individual practitioner or treatment outcome. The facility self-declares its information and retains full responsibility and liability for its services, staff, premises and products.

2. Eligibility and accounts

Accounts are for legally registered organisations. You are responsible for the accuracy of the information you provide, for keeping your credentials secure, and for all activity under your account. Providing false information or evidence is a serious breach of these Terms.

3. Fees

The self-assessment is free. Fees may apply to the on-site visit, the certificate and seal, the public profile and renewal. Fees pay for the assessment and the visibility it provides — never for a particular result or grade. The outcome is determined solely on the evidence. Fees are non-refundable once an assessment has begun, except where the law requires otherwise.

4. Certificates and the SheniEkimi marks

A certificate is valid for twelve months and covers one physical address. The SheniEkimi name, seal and marks are licensed for use only by a currently accredited facility, only for the valid period and only for the accredited address. You must not alter the marks, use them in a misleading way, or display them after expiry, suspension or revocation. We may suspend or revoke a certificate for misrepresentation, breach of these Terms, or a material change in circumstances. Misuse of the marks may give rise to liability.

5. Your content and evidence

You retain ownership of the content you submit and grant PHIG a limited, non-exclusive licence to store and process it to operate the Service. You warrant that you have the right to submit it and that it does not infringe the rights of others or contain patient-identifiable or special-category personal data (see our Privacy Policy).

6. Acceptable use

You must not use the Service unlawfully; submit false, misleading or fraudulent information or evidence; infringe the rights of others; upload malicious code; or attempt to disrupt, reverse-engineer or gain unauthorised access to the Service.

7. Intellectual property

The Service, the standard, the site content and the SheniEkimi marks are owned by PHIG and its partners and are protected by law. You are granted a limited, non-transferable, revocable right to use the Service for its intended purpose only.

8. Third-party links and content

The Service may link to or display third-party content (for example news feeds). We do not control and are not responsible for third-party content or websites.

9. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the Service will be uninterrupted, error-free or secure, or that any accredited facility will meet any particular standard at any given time.

10. Limitation of liability

To the maximum extent permitted by law, PHIG and its partners shall not be liable for any indirect, incidental, special, punitive or consequential damages, or for any loss of profits, data, goodwill, or loss arising from reliance on accreditation status or any content of the Service. Our total aggregate liability arising out of or relating to the Service shall not exceed the fees you paid to us for the relevant accreditation in the twelve months before the claim. Nothing in these Terms excludes liability that cannot be excluded by law (such as for death or personal injury caused by negligence, or for fraud).

11. Indemnification

You agree to indemnify and hold harmless PHIG and its partners from claims, losses and expenses arising out of your services, your use of the Service, your content, or your misuse of the marks.

12. Suspension and termination

We may suspend or terminate access, or withdraw accreditation, where these Terms are breached or where required by law. You may stop using the Service and request closure of your account at any time.

13. Governing law and disputes

These Terms are governed by the laws of Georgia. The competent courts of Tbilisi, Georgia have exclusive jurisdiction, except that, if you are a consumer, you keep the benefit of any mandatory protections of, and may bring proceedings in, your country of residence where the law so provides.

14. General

If any provision is held unenforceable, the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to a successor of the Service. These Terms are the entire agreement between you and us regarding the Service.

15. Changes and contact
